Yea, well, you sit back and worry about getting in trouble, while the criminals steal your stuff and walk free because you might get sued if you try to stop them.. let criminals rule your life, I'm not going to. Way to many crybabies are worried about criminal rights. They have more rights than we do in alot of cases.. If I'm on a public street and my car stalls, :D and this guy with a car load of stolen goods is obviously speeding towards me, trust me, he's getting ventilated. I'm so sick and tired of people trying to tell me whats right and wrong I can't even tell you. (Don't say merry Christmas, you might offend someone.. its happy holiday now... I don't think so! Merry Fawkin Christmas a$$hole!) I think if you go to prison you should be making big rocks into small rocks 16 hrs a day, no TV, no fun stuff, just work. Prison should not be a place to work out and hang with your other piece of sh!t buddies. I guarantee there would be less crime if it was an actual punishment. If I could type faster/better I'd tell you how I really feel ;)

If someone was stealing my stuff, I would jump in and do whatever was necessary to get my stuff back and catch the bad guy. It's the people who will sue you over stupid crap that makes people like me think three times before jumping in. If I see something going down that doesn't directly involve me or my junk, I'm not going to get involved unless there is no doubt in my mind what is going on and I'm doing what's right. There's too many things that can go wrong and I could end up on the short side of the stick. I'm no good to my family if I end up dead or in prison. Do you realize that in at least one state you can't even defend yourself from someone that has broken in your home and is in the process of stealing something UNLESS they make a threatening move towards you? You have to let them go! If you shoot them or do something to even detain them they can sue you! And most likely win! It's the morons that make these stupid laws and the people that sue over stupid stuff that are giving criminals rights, not me and my unwillingness to get involved in some car chase that I know nothing about. Until things change (which they never will because of all the bleeding heart liberals) I'm not going to get involved.

It's more than a hurdle. It shifts the burden of proof to the plaintiff and reqires that he not only show that the defendant's actions were negligent, but it also requires the plaintiff to prove that the defendant was not acting with good intentions.
If the plaintiff can't prove that the defendants actions were not out of good will, than the plaintiff must then prove that the defendant's actions met a gross negligence standard (which means that the defendant willfully or maliciously disregarded the plaintiffs safety and acted knowing, or should have known, that injury was imminent.

It's more than a hurdle, it is a litigation killer (trust me, I'm a litigator). For someone stopping to help, it's almost impossible to prove a gross negligence standard. The result, you won't get an attorney to take the case (if an attorney does take the case, knowing that the case is bad, he could face sanctions).

How about a legal opinion then? about the thread topic, as to the liability of the person in the truck, and the person posting the thread?

Fine, here is my legal opinion:
Let it go. The incident happened, and everyone is safe. It is easy to sit back and enjoy our 20/20 hindsight, but you aren't in his shoes, and you have no idea what you would have done in the same situation.

If you want to know what case law says about the situation, I bill $250 an hour . . .

:D   :D

Back on topic, Core, this was a ballsy thing to do.

I admire the fact the even though you didn't intend to be a "Crime stopper" when you got up that morning, you were in a situation where you put others before yourself, a rare thing these days.

kudos.

ps I wouldn't mind chipping in $20 to help towards getting your truck fixed.

Seriously, you shouldn't have to pay the bill yourself for what I would have done it your shoes... Just let me know...

AMEN Jinx...My thoughts exactly. I'll chip in another $20 if it helps you get your truck fixed Coreshot.

I've gotten in people's faces several times for speeding through our neighborhood. Luckily I haven't been harmed by doing so. The possibility exists, but if (heaven forbid) one of my kids ever got hit by someone speeding through my neighborhood at least I would know that I had done something in the past to try to prevent it.

Good people get sued and screwed every day. (My ex-wife is an expert.) We all have to be careful and use some good judgement, but standing on the sidelines in fear isn't the answer.

Thanks for the offer guys, but I went ahead and involved the insurance company today. They're going to take care of me.

I think everyone has had there say here, so I'll ask a moderator to go ahead and lock this topic. Visiting RME shouldn't be this stressful... ;)
