I found out I did a bad thing...

I called around today to find out who would give me the most money for this old wagoneer I am scrapping out. When one of the scrap metal people found out I cut the thing up so that it would fit in my trailer they told me that I broke Utah state law. They said I couldn't cut it up unless I had a dismantle permit. So I went looking at the codes and here is what I found:

41-1a-1010. Permit required to dismantle vehicle -- Duties upon receiving the permit -- Exceptions.
(1) (a) A person may not scrap, dismantle, destroy, or otherwise change any vehicle so that it loses its character, until the person submits to the division:
(i) the certificate of title for the vehicle for cancellation; and
(ii) an application for a permit to dismantle the vehicle.
(b) Upon approval of the application, the division shall issue a permit to dismantle the vehicle.
(2) Except as provided in Subsection (3), if a permit to dismantle is issued under this section, the vehicle shall be destroyed and may not be rebuilt or reconstructed and may not be retitled or registered.
(3) A vehicle for which a permit to dismantle has been issued by the division may be retitled and the permit to dismantle rescinded if:
(a) prior to receiving a dismantling permit the vehicle had a Utah certificate of title;
(b) the vehicle has not been dismantled;
(c) an investigator for the Motor Vehicle Enforcement Division of the commission determines after a physical inspection of the vehicle that it is the same vehicle for which the permit to dismantle was issued; and
(d) the applicant pays the fee under Subsection (4).
(4) The commission may collect a fee established in accordance with Section 63-38-3.2 to cover the expenses of an inspection under Subsection (3).

Amended by Chapter 28, 1995 General Session

I had never heard of anything like this, and I guess I have been bad because I have torn apart lots of rigs to make most of my off road rigs.....Anyone ever run into trouble when you took scraps to the shredder ????
If you read the law there are lots of folks on the board who have violated this one, especially the ones who cut most of the body off and tubed out thier rigs.

SUCK!!!

Many states have similar if not worse laws regarding dismantling. California requires you to be an insured, bonded, licensed dismantler.

You can take the title to the DMV? and get a dismantlers permit (or go to the right scrapyard ;))

Olly has scrapped dozens of rigs, give him a ring...

I have scrapped dozens of cars. stripped what I wanted and scraped the rest with no problems as long as I have a title.

I've scrapped and dismantled doesn't of vehicles as well, and never had the wrecking yards give us greif. Occasionally they'll ask what the hell happened, because after my crew gets done with a car, usually nothing is usable. Probably teh most unusual one though was we brought in a '94 ford bronco once that we cut in half, right behind the front seats, and they've never mentioned we needed a permit to do so. If this is something they are just starting to enforce, It just means more work to be able to do my job.

I just cut up what was left of my old scrambler (No i did not have a title)and threw it in the back of my old ford that was missing most of its parts. loaded em both on a trailor and took em to the scrap yard. I had a title for the truck and the was no questions asked about the front half of a jeep in its bed...... Ive never had a problem scraping anything as long as a title was involved somwhere...

I cut up a zuk to garbage can sized chunks and disposed of it over a couple months. The thing is I never had a title for it and nobody ever asked any questions.

I have cut several vehicles with no titles in half and have never had anyone say a word. I have dismantled my fair share of trucks and cars with titles as well- nobody has ever said anything.
I would think you would have to run into some kind of busy body (worrying more about everyone elses business) to have any trouble.

No, that's why living in Salt Lake county SUCKS!! To scrap a vehicle down here without a title, the recycler just tells you to cut it up first.

We got a permit after the fact when we disassembled our '77 chev short bed. Just go to the DMV and tell them you have a vehicle that has been in a bad accident, show them the title, then tell them you're going to cut it up for scrap. They'll give you the permit; they don't want to see the vehicle. The reason for the permit is to make sure the VIN isn't used for other then the intended vehicle.

Here if you don't have a title they won't take the vehicle .. so people just leave them by the road next to the scrap yard. :-\

Well I went to the scrap metal place that told me about the law with all of the pieces covered with a big tarp. The guy out back in the unloading area checked the VIN number, which I luckily had on top, against the title and gave me no trouble. He didn't even ask why it was all cut up.
I also took in a some old radiators, heater cores, broken Aluminum rims, and some other brass and copper scraps and came out with about $170 for my trouble. I went straight to Six States and used the money to help pay for new gears for my Scrambler project !!! Maybe one of these days I can get my body guy to come back and help me finish the final body work so I can join everyone on the trail.
