Do you mean because of the tire size they were rubbing on the body, or do they make contact with the frame? That really is too bad because it just looks right sitting there in front of the gas pump.

I'm not sure if the frame is in the way or not but it doesn't really matter. I'm still wanting my Jeep street legal and I'd have to cut a BUNCH of sheetmetal away to do it. Then I'd have to reconstruct it in a "Jeepish" way. I just don't have the resources to do a big build right now or in the near future. I'd also have to lower the frame height to be street legal and keep my center of gravity where I want it. The time just isn't in the cards at the moment. (I've got some kewlish body mods I've been trying to get done for MONTHS now, but haven't even gotten those taken care of. A suspension build would be worse)
The front is the biggest problem. I want to keep a steering box and that means I've only got about 1-1.5" I can't move the axle far enough forward without redoing how the steering box mounts on the frame. That's not even close to enough to make the tires work out with my current configuration.
I'll just be a lot happier with everything if I move down in tire size to a 37" Krawler (blue label) or a set of 37" MTRs. I won't have to spend a bunch of build time/cash to get it done either.
Something with actual measurements between 36-38" when mounted on the rig. The last two inches are kind of the killer for the MTRs.
These 40" tires would be awesome on a full size, though.
I just dug up a picture of my Jeep parked next to Greg's with 40" Creepy Crawlers. I'd estimate these Kevlars at least 1-2" bigger than the 40" Creepys, but I don't really know as I don't have one handy. I'd need a BUNCH of work to make my leaf sprung rig (that I already want lower) run these tires with enough room to clear them.
I'd pretty much have to duplicate Greg's build to do it right.
