emission question

my friend went and had his jeep inspected today and they failed him for not having a front sway bar do you have to have one or what

I think that there is technically a part of the inspection law that says something like " if it came on it from the factory it has to be installed and working", but most inspectors won't make a fuss over something like a sway bar.

ive heard that but a little diffrent i was told if its on it has to work but if its not on then theirs no problem

i thought it was weird cause my teacher has a 95-96 somthing like that bronco with a solid axel up front and they never give him a problem about it when he did the axel he cut all the mounts and thing off
