engine at machine shop 6 months! Now what?

This jerk has had my Jeep engine for 6 months now. He never returns phone calls or emails. The only way to get hold of him is to go down there and sometimes he's not there. Seems he's a 1 man show. When i do find him he swears it's only a couple more weeks. It's a complete waste of my time.

This is a 1942 flathead so yeah it's possible parts take time to find, but they are out there.

I admit i haven't been in a hurry for this engine but i'm tired of his lies. He always swears it's 'almost done' and it'll be done by 'friday'. I've threatened to go get it back, no matter if its apart or not.
My question is:
1. what do i do if he won't give it back?
2. What do I do about the bill? I wouldn't blame him for charging me for what he's done so far, such as clean and dissasemble the block, etc. However i'm not inclined to pay for the whole rebuild when it's not done. There was no written order or receipt on this. At least i have 2 witnesses that i dropped it off.

Go see him ask to see the engine and if he wont let you see it then tell him either i get the cops down here to get my engine or you show it to me. If he infact has it still and hasnt sold it off or something and it really has been worked on it then pay him for what he's done and get it the crap out of there! If he hasnt done anything really just tell him youlost my business and take it apart or whole. Guys like that proably just dont have time but your right he shouldnt lie to you and keep telling you its done
 
1. if he won't give it back, you take it back. Call the cops if you have to. Take him to court if any parts are missing.
2. Pay him for what he's done, and not a cent more. F him.
 
Thanks for the replies. Apparently he's out of town with a sick family member. Since he still does not return calls while away i'm in another holding pattern until he gets back. The only way i can even get this info is by calling another customer (and friend?) of his who has been quite helpful.
I would welcome any other insight from those who have been in this situation before.
 
Engine is back. I asked about his warranty and he said he'd take care of it. I asked for his warranty in writing and all he did was write '1 year warranty' on the receipt. Push comes to shove in court he could say anyone wrote that. My hope is that he's an engine whisperer and that he does good work. Otherwise he's terrible at business and customer service. If he's a terrible engine rebuilder and this thing falls apart i'm out a lot of $.
 
yeah i would be carful i mean he could be a great engine builder that just needs to get his crap together but i document everything take pics and write down what he told you build a case ahead of time so you can get your money back out of him if needed. But lets hope it dosent come to that and the engine is great
