LAND USE ACTION NEEDED - Williams V. Gubbins

Williams V. Gubbins is finally drawing to a close. This case concerns the 468 miles of roads and trails that the BLM closed in the San Rafael Swell. The Muddy Creek, Junes Bottom, Segers Hole, and the Purple trail are just a few examples of the access that was lost.

Attorney Curtis Kimble will give oral arguments in favor of our land use rights. It will be important for the judge to see that the OHV community supports this effort. Up to now it's been just briefs and motions. The oral argument phase gives the judge a chance to see the human element of his eventual decision. In addition, Curtis will feel more confident if he has a cadre of support in the gallery.

This will be the final phase in the case which will decided soon after. If we lose, then this flawed and biased travel plan will be set in stone.

YOU are invited to attend the proceedings if at all possible. Let the judge know that there is a large constituency for access in Utah.

I will do my best to be there. Added the date to my calendar.

I've been on Junes Bottom and probably a couple of the others (without knowing) before they were closed. These are historic trails and have absolutely no reason for being closed!

Who's gonna join me?

I can't be at the hearing. Is there another way we can show support?

Who is funding this? Is there a fund we can make donations to?

I'm not really with USA-ALL anymore, so I'm out of the loop. Where did you hear it was final? I can give a good guess as to the outcome.

Based on the above reasoning, the court concludes that there is no basis for overturning the decision of the IBLA affirming the BLM’s adoption of the Travel Plan. Therefore, the court affirms Defendants’ adoption of the Travel Plan and dismisses Plaintiffs’ appeal.

DATED this 18th day of October, 2007.
DALE A. KIMBALL
