Co-worker of mine is looking for one. Anyone know of one? Not a racial situation but more of dealing with a family owned business thing. Such as family members getting extra vacation time versus non-family members don't. :mad2:

If it is a family owned business then can't they do what they want with vacation? The reality may suck to a non-family member, and it may damage their business in the long run with employee moral and such, but it is their business.

One of the problems is family members getting about a month of vacation during the year. Nothing is written policey, but everyone shoud be treated fairly.

First off I am not a lawyer and this is not legal advice (blah blah blah)

Nepotism in a private company is A OK fine in just about every state and nothing ilegal about it here.

Here in Utah you should look at Title 52 Chapter 3 of the utah code which states the legal implications of nepotism when the employer is the state or local government.

I'm no lawyer, but it seems that if you're getting the vacation time that was offered to you when you accepted the job, it doesn't matter what other people get.

At most jobs, people recieve a written "offer" if they are offered the job. The amount of vacation time is part of this offer. If the employer wants the employee bad enough, they may offer more vacation time, more pay, ect...


Sueing an employer because family members get more vacation time than others, is like sueing because everyone isn't being paid the same.

I hope there is more to this potential law suit that just unequal vacation time. If this person feels they deserve more vacation time, a lawsuit isn't the way to get it, just ask. :rolleyes:

Well said, its kind of sickening how sue happy the world is today. I dont understand why people wont just go talk with each other anymore??? :confused: They all think they need to call the police and have their attorney present...

A call to the labor commission may save some attorney fees. They will tell you if you have a case. I don't know about this case but there are laws against diiscrimination, and in my opinion that is a good thing.

Well I am an attorney (ok almost . . ., but I could take your case), and if you want to know what I think; that will be $150-$250 an hour . . .
And those are billable hours mind you, which means that if I spend 6 minutes thinking about your case during the course of a day, I bill you for the entire hour.
Doing the research for your case (case law, statutes, and any applicable regulations) will take me the better part of a week (20-40 hours), and it will take me another 5 hours or so to draft a memo answering your question about feasability to sue.
Should we decide to go through with the case it will be a minimum of $1,000 to retain me for the course of the suit, and all of my time spent will be billable of course.

That, or your friend could just complain to the boss and/or quit.
