Sorry for the partial hijack... looks like I'm a bit behind the game on this thread (just heard about it for the first time today)...

A new trail...

Well, there are realistically only a very small amount of lands in the state that qualify for any user-create trail building to exist.

5MP: A small chunk out at 5MP (south of RS to the highway, nothing North of RS, nothing really south of the highway, etc.). If you take a quick look at the BLM's map for the area you will see the current designations.

So, assuming its in an open cross-country travel area, then technically you can make a trail. However it is still against the law to destroy any vegitation, etc. So any major works should really have the blessing of the governing agency.

Assuming its NOT in a currently open cross-country travel area (as indicated by the most current travel plan). Then you are breaking the law by creating any and all trails realistically, it depends on the road/proposed road at hand and the exact classification of lands where the land exists. Some areas are limited to "existing roads" so a mine road would be fine... Some are limited to "designated roads" (which is what is going to happen to 5MP soon), so a road is only fine if its on the designated official map. Case by case situation.

As for RS2477: It really only comes into play during the debate stage of the road. And you must be able to prove the road existed prior to 1976 and was NOT build using federal funds. There are a zillion other stipulations and rulings that play into the RS2477 scheme, all trying to define the originally vague law. RS2477 is still an up and coming issue as they are now just trying to install a definition for the right of way. But, as mentioned, it only comes into play when you (we) are trying to prove the validity of a route in question. Its not a basis for you to build a trail.

Remember that RS2477 does NOT apply on all federal lands (AF Canyon for example). And many lands are "protected" by a Roadless status that disqualifies roads. Once again a case by case situation.

So, if your proposed trail is NOT on an open desinated area, and is not in a existing route area. Then truly the only legal option is to seek permission from the BLM to build a new trail. Its not uncommon the ATV'ers have been doing it all over the state lately, we are admittingly a few steps behind but gaining steam. This of course should be done ASAP as with each management plan the BLM issues, the land use restrictions get more and more stingent, and retro-acting is difficult if not impossible?

I know that in the Price area we still have a fair amount of open area, but that is coming to an end soon. The draft/comment portion of this management plan is closed. With that said we(king Crawlers thus U4) have been given some more time to submit trails we were unable to get in time. That is due to a number of issues that I need not get into now. Along with this extra time they have given us some guide lines that they would like to see and thus may be of use to this thread. Most of the guide lines cover minimal impact stuff like no constant water or vegetation, others include stuff like rs2477 or visual impact.

Glad you guys are all over the trails in the area Scott :cool:

In addition to Price & 5MP, there is Little Sahara, small section at Factory Butte, some stuff at the dunes by St George. Where else? I'm assuming some of the stuff west of Great Salt Lake? I'll have to bust out my maps as I know there some other small areas (south of Green River, etc). And as with Price, most (all) of those will change status in the coming years... :eek:

Sorry Im not in the Army. I'm just a constrution guy trying to get a pay check every two weeks. If you need a foundation dug I got the toys to do that. You need a road dozed got two of those, you need someone burried in a foundation, I got the hook up on that.

As for the SGT. thing nope, Not that good of eyes. I would not trust me behind a rifle.

No I was not I was in Layton on Saturday working.
I drive a 97 TJ. It has been in the shop for about a month. Im geting the new axles put in and stretching it. I hope it will be ready to roll by spring.
