Non Compete?

The company I work for has a non-compete as a condition of employment. No sign, no job. They follow that with a round of "ethics" training where the penalties are pounded into us. On the other hand, very very few places do what we do, and this outfit has pretty much absorbed the outfits that do the same... Yet, they don't fall under any anti-trust rules.

Non Competes are legitimate ways for employers to protect their customers from being siphoned by an employee or ex employee. But you have to cause damage to that company for them to be able to take action. I don't know what kind of business you are in, if it is something where you are building your own book of business and receiving a commission from those sales, you would be prohibited from taking that business elsewhere, for a period of one year. It has nothing to do with you taking a job with a different company in a different role, but if you were taking a position that would eliminate the need for your current company to do business with the other company that would be a violation of the non compete. It doesn't sound like your too concerned about it, and honestly, If you really were taking a position that would better your personal circumstances without damaging your current employers status with the new employer, there isn't a judge in the state that would rule against you.

I know somebody who signed a non-compete and then when he quit because his boss was a douche, he strolled into the office that night (still had the key) and swiped the non-compete. he started to do the same trade on his own, not stealing any customers or anything, and the old boss freaked out, threatened him, got even more pissed because he couldn't find the non-compete, then forged one to try to scare this guy, thinking that the guy would believe that it was the one he had signed.......:rofl:

wow, two criminal acts, your friend stole, a legal document and his exboss forged a legal document, they should possible both share a Jail cell together for a weekend and work it out.

All of my employees have signed non-compete and disclosure clauses, I wont hire anyone without them.. doesnt have anything to do with trying to get all you can out of an employee, and making them a slave that cant go elsewhere. It cost a lot of money and time to train someone, and in some cases they are let in on all your trade secrets, they could set up shop across the street or go to work for a competitor and take with them an advantage over you. I value my employees, if they chose to leave for a better position even in my field, as long as it didnt harm my business, I wouldnt care, id even give them a letter of recommendation.
