From what I can see from the billboard it is 1st amendment rights and I don't think there would be a case.

HIPAA. It is illeagal to make private medical information public without permission from the individual. If it was me, i would be filing a law suit against PETA. There is no excuse for that behavior at all. 1st ammendment should not apply here.
