Question about HOA's, the boot, and snow covered parking signs...

So, long story short...

Late Saturday night I was visiting some friends that had just purchased and were moving into a new condo in W. Jordan. It was after that bad snow/wind storm, and I had parked on the street. 15 minutes later I was told that my car was being towed. I walked out, and the guy had booted my car, and I had 20 minutes to come up with $104 cash or else it was going to be towed. I went to get the money, and on my way back couldn't help but notice that the "no parking" sign was completely covered with snow and could not be seen. I pointed this out to my new friend in the tow truck and he said it's the homeowner’s responsibility to inform guests that they can't park on the street. I'm sure that’s fine for most people, but they homeowner hadn't even lived in the place for 12 hours...so I think a little flexibility should be in order.

At any rate, the owner of the towing company doesn’t seem particularly interested in making concessions due to the circumstances. He was polite though. I'm just frustrated because I don't believe the "ignorance is no excuse" clause can really be used here since it's on private property and the spirit of the rule is to keep fire lanes clear for emergency/snow plow access. If the privately contracted enforcement company (acting on behalf of the HOA) was really interested in preserving emergency access (instead of profiting from the testicular stranglehold they put on people) then he wouldn't have booted my car making it immobile for 40 minutes. Instead, I think he would have either A)said something to the 3 people smoking in the driveway 3 FEET away and given me the opportunity to move it or B) had some compassion after he realized nobody had any idea that parking was not allowed there and there were no fixed signs stating that was the case.

All frustrations aside, do I have any recourse? Do you think that the HOA has either the care or the clout to do something about this sham artist effin tow company that took me for $104?

Is it even worth taking it to small claims court?


I do have pictures of the snowpacked sign too in case that would help.

I say "pick your battles"

I agree that you are probably in the right on this one. And a judge would maybe-probably side with you. Is it worth the time and effort to take that one to court? Best case situation is that you get your $104 back and only lose the hours of time away from work about it.

Maybe start with a complaint to the HOA, and the tow truck company. See where that takes you.

From their side the HOA has to have someone to tow people. They just called the tow company and said "come watch our place". The tow guy just gets paid to boot or tow cars. From their eyes they are all "just doing their job". But maybe you can find a HOA member who is a little understanding and will try to get your money back.

How come you get all the bad luck.

Eh, I'll stay on the outside this time. Besides, their fence was sharp and destroyed a brand new pair of pants.

Talk to Kurt though. I know he got his money back when they towed his truck once. I'm wondering if it was the same condo's you were at.

I wouldn't waste too much time for a hundred bucks. Just let it reinforce in your mind that you will never ever ever under any circumstances purchase a home that is governed by an HOA.

My buddy that I used to tow for had to do the same to a new neighborhood by his house. He was contracted by the HOA to do the job. He would drive through the area to his home at the end of the day, grab dinner and a little tv. So about a 1-2 laters anything left out got snagged. The residents soon learned to listen for the sound of the truck.:D He felt bad for the people but it was his job to do. Good luck, I think your screwed. But I agree that that's crap that a resident has been there less than 12 hours and getting towed. My buddy knew who the newbies were and tended to look the other way.

Those guys are leeches. ANd HOA's suck ass.

HELL YES take it to court!
Here is what I'd do:

Call the news. There have been a rash of these stories as of late, and the news media has come down VERY hard on the tow truck companies.

But, before you do that call the apartment manager/HOA president, tell him your plan to sue to tow truck driver AND Call the news, and give him a chance to refund your money and avoid the bad publicity.
It isn't a threat, it is a friendly, courteous thing to do.

If this doesn't fly, file the papers in small claims court and call the newspapers/TV stations.

On your small claim suit, ADD COSTS!!! Figure out the time you spent on the case, and put a $$$ figure next to it.

You know about as much as I do about filing a claim in small claims court, but I'd be happy to argue it for you in court if the schedules work out.

I got towed once from an apartment complex that was in with a towing company I think they split the money between the two of them because they were both total nazis about it. I got my money back because I was in the right and actually had a pass to park there they just didn't look hard enough in the tinted windows...:mad: It took me a full day to argue and negotiate between th manager of the apartments and the towing company, but I got the car and the money back (half from each side)...

I think it is total BS and it definately isn't worth fighting over for the money but it might be worth fighting over for the principle. That is all up to you though, I have a feeling they make enough money over it not to change over one case...:-\

I'm not suggesting this, but I think a trash can full of dog poo and water, leaned up against the HOA president's door in the evening, accompanied by a few loud knocks would prove quite satisfying... in a purely theoretical way...

Oh, and you can't move the can if its full of water, so use the hose at the house. I mean, in the theoretical universe...

I did get my money back from the HOA on the first instance... similar situation where the signage was not even on the street I was parked on. Furthermore their newsletter said they would be giving "warnings" and towing in the future. I basically told the HOA and the wrecker that I had nothing better to do then seek justice, they would be summoned to court to face the facts or send me a check next day air, I sent them a certified letter with a copy of the newsletter as well as a picture that showed that there wasn't even a no parking sign on the road indicated. I wasn't an as* or a prick about it, but what they did was unfair. Its preditory towing at its best... those guys loiter around the complex just waiting for someone to park out of place, even if its for 5 seconds to pick up a freind, etc. We're not talking about fire lanes here, these were regular streets with plenty of width. Additionally I was booted while my truck was running, he demanded cash and I was in a hurry... I had to pay :mad:

Round 3, well you've all heard the story... sawzalls, repo trucks, bolt cutters, 007 style ops, police, fights and 3 liberated cars. In the end I feel like we won :D We lived there for another 3-4 months, never saw Smoky Mountain around again :D

Anyway you can call a tow truck to tow the tow truck that parked in the no parking zone to tow your vehicle? Just thinking out loud. :eek:
