The way they word it, it sounds as if there is some kinf od loophole about "tampering"... but I never saw "ther rules relating to tampering" on the entire file?

I am sure tampering fails just the word sounds bad. The section about no tests at all now is 10.3.3.1 .

The swap we did was going from a 4.2 to a 5.0 smallblock v-8. When they CERTIFIED it, they did not say anything about it being labeled tampered.

When did you do it? Were they cool about it or was it a hassle. I called them 7 years ago and they said it was not possible.

I had a problem with my sammy and swapping the carb. By state law, it is legal to use the Webber carb, as long as it makes the vehicle emissions better, and you have proof of it. However, I was told (by a state emmissions person) that by some federal law it is illegal, thus overriding the state law. so I can't have a Webber carb, and now I can't have a Vortec either? this sucks! :mad:

I just called them. The guy went on and on about Federal Law. He said that you can only swap engines from the same manufacturer. He actually said that if I used a later Jeep V8 in a earlier Jeep it would be OK. Seems funny since Jeep used Buiks, Chevys, Dodge engines over the years. He says this is the feds law not theirs and if I wanted to pay a $20,000 fine go for it. He says that they may test conversions with other makes of engines but it does not make it right. He actually said that a lot of people speed too but that doesn't make it legal. I am really confused. After talking to this guy it seems that the 5.9 Dodge might be the hot legal Jeep swap. I bet I could call next week and get a completely different answer.

Always. My outlook has been to ask alot of diffrent Gov. employees, untill you get the answer you want! It never fails when dealing w/ the Government! :rofl:
 
the law has loopholes in it for a reason, and it makes it very confusing. The guys helping to do my swap said that you have to go to the county comissioner and he has to verify the emission stuff and then the vehicle is tested as that year (2003 instead of 97 in my case). I'm going to call (now I cant think of the name, They make the HELLDORADO jeep and the strangler wrangler) and ask how they get away with it.

P.S. Kurt you wouldn't know how to get your hands on the colorado emissions page would ya. I might still be able to register there cause i'm still a resident.
 
Also what if you bore out an engine (stroker kit, bore out, ETC... wouldn't that change the displacement and by this law make it "tampered" ? But when you re-build and engine you almost have to bore it out just to make it work nice again., so how does that work ?

as far as the rebuild thing. I think as long as it appears stock there should be no problem. no sense in giving them a red flag to look at, right:)

It's too late to worry. The swap is in progress. You will get it registered. Trust me where there is a will there is a way.

all of you have covered most of every thing there is about engine swaps but most of it is wrong or just mixed up. Too get the right information this is what you need to do: (for utah county only)

1st Figure out what you want to do. ( what motor you want to run and what vehicle you want to put it into. Make sure you bring all the correct information about the car; make, model, year.)

2nd Take all of this down to the Salt Lake Valley Health dept. on Woodoak lane. You can also call them but it is easier to do this in person.

3rd Park in the rear of the building and enter through the door by the 3 bay doors. (Emission Dept.)

4th ASK...ask the nice lady at the counter, this is the sure-fire way to get the right information for your vehicle the first time.

hope this will help save some of the emission headaches before doing the swap.

As for the engine build-up goes: Do it. There is nothing on the books that state anything about built motors. Just make sure you do not remove any of the emission devices. Like Cats, Egr's, A.I.R pumps, ect. Also any changes that you make to a motor will change what comes out of the tail-pipe. Just keep that in mind.

Here is the rule in colorado:
(407.0) ENGINE CHANGE:

(a) FOR THOSE VEHICLES IN WHICH THE ORIGINAL ENGINE HAS BEEN REPLACED, THE EMISSION LIMITS AND APPLICABLE EMISSIONS CONTROL EQUIPMENT FOR THE YEAR AND MODEL OF THE VEHICLE BODY AND CHASSIS, AS PER REGISTRATION AND TITLE OR REPLACEMENT ENGINE, WHICHEVER IS NEWEST SHALL APPLY. FOR THOSE DIESEL-POWERED VEHICLES WHICH HAVE BEEN CONVERTED TO OPERATE ON FUELS OTHER THAN DIESEL' THE EMISSIONS LIMITS AND APPLICABLE EMISSIO CONTROL EQUIPMENT FOR THE YEAR, MAKE AND MODEL OF THE GASOLINE-POWERED ENGINE EQUIVALENT AS ORIGINALLY MANUFACTURED, FOR THE VEHICLE BODY AND CHASSIS, PER THE REGISTRATION OR REPLACEMENT ENGINE, WHICHEVER IS NEWEST, SHALL APPLY AS DETERMINED BY THE EMISSIONS TECHNICAL CENTER PERSONNEL OR DESIGNEE AND SPECIFIED ON AN OFFICIAL EMISSIONS PROGRAM VEHICLE EVALUATION FORM DR 2365.

(b) FOR 1975 AND NEWER VEHICLES IN WHICH THE ORIGINAL ENGINE HAS BEEN REPLACED, IF EITHER THE VEHICLE BODY OR CHASSIS OR ORIGINAL ENGINE, AS PER. REGISTRATION AND TITLE OR REPLACEMENT ENGINE AS MANUFACTURED HAD A CATALYTIC CONVERTER SYSTEM, AIR INJECTION REACTION SYSTEM, MICROPROCESSOR BASED AIR AND FUEL CONTROL SYSPEM, AND. FUEL FILLER NECK RESTRICTORS, THESE EMISSIONS CONTROL SYSTEMS MUST BE PRESENT, INTACT AND OPERATIONAL-BEFORE A CERTIFICATE OF EMISSIONS CONTROL MAY BE ISSUED.

(c) FOR THOSE VEHICLES TITLED OR REGISTERED AS MODEL YEAR 1975 AND NEWER, THAT WERE ASSEMBLED. BY OTHER THAN A LICENSED MANUFACTURER SUCH AS KIT-CARS, REGISTERED AND TITLED ACCORDING TO 42-6-107.5 AND 42-6-117 C.R.S., AND ASSIGNED A COLORADO IDENTIFICATION NUMBER, THE APPLICABLE EMISSIONS CONTROL EQUIPMENT AND STANDARDS WILL BE BASED UPON A DETERMINATION BY TECHNICAL CENTER PERSONNEL OF THE VINTAGE OF THE VEHICLE ENGINE. AN AFFIDAVIT MAY BE ISSUED BY THE TECHNICAL CENTER PERSONNEL AND THE YEAR OF THE ENGINE SHALL BE PRESUMED TO BE THAT STATED BY THE VEHICLE OWNER UNLESS IT IS DETERMINED BY TECHNICAL CENTER PERSONNEL OR DESIGNEE, AFTER PHYSICAL INSPECTION OF THE VEHICLE ENGINE, THAT THE YEAR OF THE ENGINE IS OTHER THAN STATED BY THE OWNER.
