Anyone read this story in today's Trib:

"The Krahenbuhls claim the resort was negligent by failing to warn competition participants of the potential for brake failure when traveling the road with a loaded trailer."

The road... State Route 158 in Weber County. Yeah its steep its a paved route maintained by the State of Utah. Sucks the kid died but driving too fast for the conditions in a motorhome towing a 24' trailer is the culprit... not Powder Mountains failure to warn participants of 'brake failure'. :rolleyes:

You know, I hope they lose that lawsuit! The parents and the driver need to take responsibility for what happened.

It amazes me how many people don't even know how to downshift their vehicles for steep grades. Which is what I'm betting caused the brake failure, riding the brakes down the mtn. Sad that their own ignorance took the life of their son. Even more sad that they are trying to place the blame elsewhere.

Flippin idiots, they should be suing the driver for being so stupid!! I suppose that since they lost their meal ticket they need to get money somehow. And I'm willing to bet money the kid wasn't even buckled in!

If they win, It opens a door for every person that runs off the road on every mountain pass that has no sign to sue the state or county because they didn't know they needed to slow down. I predict a settlement from the insurance company's but not a win in court.

I used to work for a pharmaceutical company in NJ.

A woman, who was taking one of the medications we produced, was on her roof in high heels. She fell off and got banged up.

Naturally, she sued us.:rolleyes:

The only way to stop this BS is to have tuff judges and penalize lawyers for frivolous lawsuits.
 
everyone is sue happy these days.... maybe i should sue alpine school district for allowing me to not graduate... i didnt put the effort into school. it was my fault i didnt graduate.. but maybe if i sue the school district for letting me fail and not helping me see what the future would hold for me.. i dont trust our judicial system... guilty people get off and innocent people get life cause they "was forced to lie to take a plea deal to get a lighter sentence....

That knucklehead couldn't be more wrong, IIRC the restaurant is only required to be ADA compliant if it is a public venue/service and receives federal aid of some sort. The restaurant can even legally deny him service if it chooses.

When I worked for Southeast Toyota Distributors the entire 2nd floor of Building 1 was occupied by the legal dept. Most of the lawsuits that kept them busy were brought by Toyota dealers... lame. These days, I bet they had to build a separate building to house the legal dept.

Ummm in a word, no. ADAAG applies to all new construction (after 1993) of Places of Public Accommodation and Commercial Facilities. Restaurants and hotels are included in that definition.

but I don't believe being fat is in the ADA
